1. Acceptance of terms
By using CarNerX — the website, mobile app, or any related service — you agree to these terms. If you don't agree, please don't use CarNerX. These terms apply to buyers, private sellers, verified dealers, and anyone browsing the platform.
2. The marketplace
CarNerX is a venue that connects buyers and sellers of vehicles in The Gambia. Browsing, searching and viewing listings is free and does not require an account. Contacting a seller, saving a car, making an offer, or requesting a CarNerX service does require a free account.
CarNerX is not a party to any sale. Every transaction — the negotiation, the price, the handover, and payment — happens directly between the buyer and the seller. CarNerX does not inspect, own, or guarantee any vehicle listed on the platform unless a completed CarNerX Verify report says otherwise, and even then, subject to section 4 below.
3. Payments
CarNerX does not process card payments anywhere on the platform, and never will for consumer purchases. Vehicle payments between buyers and sellers, dealer subscriptions, and CarNerX service fees (Verify, sales agreements, legal, insurance) are settled directly by cash, bank transfer, or mobile money. Never send payment for a vehicle to CarNerX itself — CarNerX is not the seller.
4. Verification & buyer responsibility
CarNerX Verify is an optional service that checks a vehicle's identity, papers, seller information and, where requested, its physical condition, before you pay.
If you buy a vehicle on or through CarNerX without a completed CarNerX Verify report, that purchase is entirely at your own risk and is solely your responsibility. CarNerX is not liable for any loss, damage, fraud, misrepresentation, mechanical fault, defect in title, or dispute arising from a transaction that was not verified through CarNerX Verify.
Even where a CarNerX Verify report has been completed, it reflects only what was found at the time of inspection. It is not a guarantee of the vehicle's condition or of the seller's conduct, and CarNerX remains not a party to the sale. Buyers are strongly encouraged to request CarNerX Verify, a sales agreement, and — where appropriate — a legal review before paying for any vehicle.
5. Services (Verify, legal, insurance, financing)
CarNerX Verify inspections, sales agreement preparation, and CarNerX Verify report generation are carried out by or coordinated through CarNerX. Legal review, documentation and legal assistance are provided by independent partner law firms licensed in the country of the transaction — CarNerX is not a law firm. Insurance quotes are provided directly by independent partner insurers — CarNerX is not an insurer and does not underwrite any policy. Financing, when available, will be provided by participating banks and finance houses, not by CarNerX. In each case, CarNerX's role is to make the introduction and coordinate the request; the professional service itself is the responsibility of the named partner.
6. Dealers
Dealer accounts require an application, document review, and an approval decision by CarNerX operations. Approval as a CarNerX Verified Dealer confirms that the business was checked — it does not guarantee any individual vehicle a dealer lists. CarNerX may suspend a dealer's account for violations of these terms, fraudulent listings, or failure to maintain an active subscription.
7. Accounts
An account requires a full name, email address and password. You're responsible for keeping your password confidential and for all activity under your account. CarNerX does not charge consumers for an account, ever — there is no buyer subscription or paywall.
8. Prohibited use
You may not: list a vehicle you don't have the right to sell; post false, misleading or duplicate listings; misrepresent yourself as a dealer without an approved application; use CarNerX to facilitate fraud; or attempt to circumvent CarNerX's verification, moderation or reporting systems. Reported listings and accounts are reviewed by CarNerX operations and may be suspended or removed.
9. Privacy
We collect only what the platform needs to work:
- Account details — full name, email, password (stored securely, never in plain text), and phone number where you provide one for buyer/seller contact.
- Listing details you choose to publish — vehicle information, photos, location and price.
- Activity needed to run the marketplace — inquiries, offers, saved cars, service requests, and a log of when your contact details are revealed to another user.
Your phone number is never shown to a visitor who hasn't created an account, and is only shared with another user when you choose to contact them or they reveal your listing's contact details after signing in. We don't sell your personal data. Service partners (insurers, law firms, inspection partners) only receive what's needed to fulfil the specific request you make to them — your name, phone number and the relevant vehicle details, nothing more.
10. Changes to these terms
We may update these terms as CarNerX grows. Material changes will be reflected here with an updated date. Continuing to use CarNerX after a change means you accept the updated terms.
